Human Fuel Mini Program – Terms and Conditions

1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (the “User” or “You”), and Human Fuel ("We," "Us," or "Our"), concerning your access to and use of the Human Fuel Mini Program (the “Mini Program”).

By accessing or using the Mini Program, you agree that you have read, understood, and agree to be bound by all of these Terms and Conditions. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS AND CONDITIONS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE MINI PROGRAM AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted in the Mini Program from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason.

2. The Mini Program (Loyalty Web App)

The Mini Program is a dedicated web application designed to manage and facilitate the Human Fuel Loyalty Program. This includes, but is not limited to, allowing Users to:

  • Track qualifying purchases.
  • Earn, view, and redeem loyalty points, credits, or rewards ("Rewards").
  • View their current membership status and benefits.
  • Receive and access communications and offers specific to their loyalty membership.

You agree that all services, features, and content provided through the Mini Program are subject to these Terms and Conditions.

3. Loyalty Program Rules and Limitations

3.1. Rewards Value and Nature

Rewards earned through the Mini Program have no cash value and cannot be redeemed for cash or transferred outside of the Program unless expressly permitted by Us. Rewards are merely rights to discounts or benefits provided by Human Fuel, which may change at any time.

3.2. Program Changes, Suspension, or Termination

We reserve the right, in our sole discretion, to modify, restrict, suspend, or terminate the Loyalty Program, or any aspect thereof (including but not limited to the types of Rewards offered, the earning criteria, and the value of points), at any time. We will endeavor to provide reasonable notice of such changes where possible. By continuing to use the Mini Program after such changes, you accept the revised terms.

3.3. Forfeiture and Expiration

Rewards are subject to expiration and forfeiture. Human Fuel reserves the right to cancel or deduct Rewards from your account if they were erroneously credited, are linked to fraudulent activity, or if your account remains inactive for a period of [Specify Period, e.g., 12 consecutive months].

4. User Representations and Responsibilities

By using the Mini Program, you represent and warrant that:

  1. You have the legal capacity and you agree to comply with these Terms and Conditions.
  2. You will not use the Mini Program for any illegal or unauthorized purpose.
  3. Your use of the Mini Program will not violate any applicable law or regulation in Malaysia or elsewhere.
  4. You are at least 18 years of age, or possess legal parental or guardian consent, and are fully able and competent to enter into these terms.

5. Intellectual Property Rights

Unless otherwise indicated, the Mini Program and all content, features, and functionality (including, but not limited to, all information, software, text, graphics, designs, and logos) are owned by Human Fuel or licensed to Us, and are protected by applicable copyright and trademark laws.

The content and intellectual property within the Mini Program are provided to you "AS IS" for your information and personal use only related to the Loyalty Program. No part of the Mini Program and no content may be copied, reproduced, republished, uploaded, posted, publicly displayed, transmitted, distributed, sold, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

6. Prohibited Activities

You may not access or use the Mini Program for any purpose other than participation in the Loyalty Program. As a user, you agree not to:

  • Attempt to hack, tamper with, or manipulate the earning or redemption of Rewards.
  • Systematically retrieve data or content from the Mini Program to create a collection, compilation, database, or directory without written permission from Us.
  • Make any unauthorized use of the Mini Program, including collecting usernames and/or email addresses of users for unsolicited email.
  • Circumvent, disable, or otherwise interfere with security-related features of the Mini Program.
  • Engage in fraudulent activities related to the Loyalty Program or your account.

7. Privacy Policy

We care about data privacy and security. Please review our separate Privacy Policy, which explains how We collect, use, and disclose your personal data. By using the Mini Program, you agree to be bound by our Privacy Policy.

8. Term and Termination

These Terms and Conditions shall remain in full force and effect while you use the Mini Program. WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE MINI PROGRAM (AND CONSEQUENTLY FORFEIT ALL EARNED REWARDS) TO ANY PERSON FOR ANY REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF THESE TERMS AND CONDITIONS OR FOR ENGAGING IN FRAUDULENT OR UNLAWFUL ACTIVITY.

9. Disclaimers

THE MINI PROGRAM IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE MINI PROGRAM WILL BE AT YOUR SOLE RISK. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE MINI PROGRAM, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE MINI PROGRAM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT THE REWARDS WILL ALWAYS BE AVAILABLE.

10. Limitations of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE MINI PROGRAM OR PARTICIPATION IN THE LOYALTY PROGRAM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to defend, indemnify, and hold Us harmless, including Our subsidiaries, affiliates, and all of Our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your use of the Mini Program; (2) breach of these Terms and Conditions; or (3) your violation of the rights of a third party, including intellectual property rights.

12. Governing Law and Dispute Resolution

These Terms and Conditions and your use of the Mini Program are governed by and construed in accordance with the laws of Malaysia. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of Malaysia.
